1. Who we are and when this policy applies
NativeCut, Inc., 2810 N Church Street, STE 90517, Wilmington, DE 19802, United States, operates the video localization Services at nativecut.io. Contact support@nativecut.io with privacy questions or requests.
This policy explains our handling of personal information associated with our website, accounts, billing, support, and use of the Services. For these purposes NativeCut generally determines why and how information is used and acts as a controller.
When a customer submits videos or other materials containing personal information for us to process on its behalf, we act as a processor or sub-processor as applicable. The customer's instructions, applicable agreement, and DPA govern that processing. If your information appears in such material, the customer ordinarily handles decisions about its use; we will assist as required. We do not treat every person appearing in a customer's film as an account holder.
2. Information involved
Information needed to operate an account and carry out requests includes account identifiers and contact information, purchase and credit-balance records, support correspondence, uploaded audiovisual material, processing instructions, and resulting Outputs. A video may contain faces, voices, names, or other information about people who are not registered users.
We receive information you submit and records generated when we process your requests and transactions.
If you join our early access list, we collect the email address you provide to send you updates about early access and the platform launch.
We also process technical records needed to operate, troubleshoot, and secure the Services, and information needed to authenticate users and administer payments. The information involved depends on the features you use.
3. Purposes and legal grounds
Where GDPR or comparable rules require a legal basis, we use the bases below for NativeCut's controller activities. Processing customer films on instructions is addressed separately in the DPA.
| Purpose | Information involved | Applicable basis where required |
|---|---|---|
| Set up accounts and deliver requested account functions | Contact and account information | Performance of our contract with an individual user; legitimate interests in administering an organizational customer's account where the individual is its representative |
| Process purchases and maintain credit records | Transaction, billing, and account information | Contract performance; applicable accounting and tax obligations |
| Answer requests and resolve service problems | Contact details, correspondence, relevant diagnostics | Contract performance or legitimate interests in customer support; customer instructions govern any processor access to films |
| Protect accounts and investigate misuse | Relevant security and usage records | Legitimate interests in preventing fraud and securing the Services, and legal obligations where applicable |
| Evaluate technical performance and improve features | Technical processing records and voluntary feedback | Legitimate interests in operating and improving the Services, subject to consent requirements for the collection method |
| Understand website visits and early-access interest when Analytics is enabled | Pseudonymous browser and session identifiers, page visits, campaign labels, selected link clicks, and successful early-access submissions without the submitted email address | Consent where required; otherwise legitimate interests in measuring and improving our website, subject to our regional policy and your ability to opt out |
| Comply with law and handle legal claims | Relevant records | Legal obligations and legitimate interests in establishing, exercising, or defending claims |
Where consent is used, you may withdraw it without affecting prior lawful processing. We do not rely on acceptance of this policy as a blanket consent. If information is needed for a contract or a legal obligation and is not provided, we may be unable to provide the affected feature or transaction.
4. Customer materials and AI
NativeCut uses submitted videos and associated material to perform requested localization and deliver Outputs. Authorized team members may examine relevant material when dealing with a support request.
NativeCut does not use Customer Content or Outputs to train AI models. We will not use customer films, Outputs, or customer names and logos in marketing or case studies without separate permission for the relevant use.
We may improve the Services using technical performance information, feedback, and troubleshooting associated with your support request. This does not authorize unrelated reuse of the audiovisual substance of customer materials, model training, or marketing use.
5. Recipients
We use Formspree to receive early access signups. When you submit the early access form, your email address and form submission are sent to Formspree for processing on our behalf.
Vercel hosts this website. When Analytics is enabled and permitted by the regional policy and your preferences, Google Tag Manager loads Google Analytics 4 to process website measurement data. Google receives the technical information associated with those requests. We do not send your early-access email address or other form values to Google Analytics. See Google’s privacy information for more about its handling of information.
We disclose information needed to carry out processing to providers operating relevant infrastructure and AI functions. We also disclose information as legally required, to professional advisers for legitimate business or legal needs under appropriate duties, and as necessary for a business transaction subject to applicable safeguards.
Our AI processing providers include Google and OpenAI. We share material with these providers as needed for the AI functions you request. For information about providers involved in your processing, contact support@nativecut.io. Where applicable, a separately agreed DPA governs subprocessors handling customer personal data.
We do not authorize publicity merely because you upload a film. Any optional integration or public-sharing feature must have an accurate description of its recipients and controls before it is enabled.
6. Cookies, regional choices and optional communications
We use c15t on this website to remember cookie choices in your browser, under the key nativecut-consent-analytics, for up to 180 days on the current host. This preference is stored locally, not sent to a separate c15t consent service. Necessary technologies may also support functions you request, such as sign-in and security.
When Analytics is enabled, it measures visits to our public website, selected early-access or demo-link clicks, and successful early-access form submissions. It does not measure form contents, video playback, or activity in the editorial CMS. We do not use this integration for advertising, remarketing or Google signals.
We use a coarse country and subdivision supplied by our hosting provider, Vercel, to select a regional cookie policy. The website does not request GPS location. The regional response is not stored as a location cookie or sent to Google as a custom event parameter. If location cannot be determined, we require consent before Analytics starts.
Our policy requires an explicit Analytics choice in opt-in regions, including the EEA, United Kingdom, Switzerland, Brazil, Japan, South Korea and Canada. Other countries not assigned a reviewed policy also require consent. In the United States and Australia, Analytics may start without an automatic banner unless you have opted out or your browser sends Global Privacy Control. A saved refusal and Global Privacy Control are respected in every region.
Use Cookie settings in the footer at any time to review or change your Analytics choice. Rejecting Analytics does not affect navigation, video playback or early-access signup. Saving a refusal stops future measurement; if Google has already loaded, the page reloads after the refusal is saved. This does not erase information already received by Google. No Analytics banner is shown when this integration is disabled.
| Storage or data | Purpose | Retention |
|---|---|---|
| nativecut-consent-analytics cookie and localStorage | Remember your cookie preference | Up to 180 days on the current host |
| _ga and _ga_* cookies, when Analytics is permitted | Distinguish browsers and sessions for website measurement | Configured for up to 180 days without renewal on each visit; browser limits may shorten this |
| Google Analytics user and event records | Analyze website use | Configured for two months without reset on new activity. Standard aggregated reports are not deleted on this schedule. |
Where we rely on consent, you can withdraw it without affecting earlier lawful processing. If we send optional marketing messages, you can unsubscribe through the message or contact us. Service and transaction notices may still be needed to administer your account.
7. Processing locations and international transfers
NativeCut is incorporated in the United States and works with external providers. Processing may involve countries other than your country of residence, whose data protection laws may differ. Contact support@nativecut.io for information about the locations relevant to your use of the Services.
Where a transfer requires safeguards under applicable law, we will use an applicable lawful mechanism. You may contact support@nativecut.io for information about relevant safeguards and how to obtain a copy, subject to lawful redactions.
8. Retention and deletion
We retain information for the stated processing purposes and applicable legal requirements, then delete or anonymize it as appropriate. Customer-content processing follows the applicable contract and DPA. The current operating policy distinguishes video files from account records and project metadata.
| Category | Retention period or precise criteria |
|---|---|
| Uploaded source videos | Automatically deleted 14 days after upload, unless a separate storage offer expressly states otherwise, subject to earlier valid deletion requests and legally required retention. |
| Generated video files | Automatically deleted 14 days after generation, unless a separate storage offer expressly states otherwise, subject to earlier valid deletion requests and legally required retention. |
| Project metadata, account and authentication records | Kept while needed to maintain the account and requested projects. On closure, deleted unless continued retention is justified by a specific legal obligation or lawful need, such as unresolved transactions or claims; reviewed when that need ends. |
| Billing, credit, tax, and transaction records | Kept to administer purchases and balances and for applicable accounting, tax, and legal recordkeeping periods. |
| Support and security records | Kept while needed to resolve the request or incident and address related legal requirements or claims. |
| Temporary files, voice artifacts, technical logs, and database backups | Retained only as needed for processing, troubleshooting, security, and recovery, or applicable legal obligations. Backup copies are subject to the deletion safeguards described below. |
| Backups of uploaded and generated video files | NativeCut does not currently create these backups. |
| Copies retained by external providers | Retained as needed to perform the contracted processing and meet applicable legal obligations, subject to the relevant provider arrangements and any applicable DPA. Contact us for details relevant to your processing. |
You can email support@nativecut.io to request deletion of your account, personal information, or submitted material. We will carry out proportionate verification where needed and respond within applicable legal deadlines. Erasure is subject to lawful exceptions, including records required for legal obligations. We will explain any applicable reason for retaining information rather than promise that every record is erased immediately.
The 14-day video schedule applies while an account remains open; stored project metadata does not preserve the underlying video. Backups are not an exception to applicable deletion obligations. Where immediate removal from an isolated backup is not feasible, information awaiting expiry must not be returned to ordinary use, and an applicable deletion request must be reapplied following recovery.
9. Security
We are responsible for implementing safeguards appropriate to the risks of our processing. No online service can guarantee that unauthorized access or data loss will never occur.
Where a separate DPA applies, it also governs safeguards for customer data processed on instructions. No particular certification, audit report, or dedicated security service is promised by this policy.
10. Your rights and requests
Depending on applicable law, you may have rights to access or obtain a copy of information, correct it, request deletion or restriction, object to certain processing, obtain portability, and withdraw consent. Rights are subject to applicable conditions and exceptions.
Send requests to support@nativecut.io. We may need proportionate identity or authority verification and will respond within the period required by applicable law. Where NativeCut is a processor, we will refer requests to the relevant customer or assist it as appropriate rather than independently override its instructions.
You may complain to an applicable data protection authority, including the authority in your country of habitual residence, workplace, or the place of an alleged infringement where GDPR applies. You need not first complain to us.
Where applicable US state law gives you additional rights, including opting out of certain data uses, appealing a decision on a request, or acting through an authorized agent, contact us using the same address. We will not discriminate against you for lawfully exercising your privacy rights.
11. Children and people appearing in films
Accounts are intended for people aged 18 or older. If we learn that an ineligible child has registered, we will address the account and associated data as required by applicable law.
This account restriction does not mean all people depicted in customer videos are adults. Customers must have the authority and permissions needed for processing submitted material, including material involving children.
12. Changes and contact
We may update this policy when practices or requirements change. We will identify the effective date and provide notice of material changes as appropriate or legally required. An updated notice does not, by itself, supply consent for a new purpose where consent is required.
